Terms of Use

1. Scope

These terms apply to the use of the Quapp app, provided by Janek Bieler (see Imprint for contact details). By using the app you agree to these terms. Use is free of charge and permitted from the age of 13.

2. Your account

You can play as a guest, create an account with an email address or sign in with Apple. You are responsible for keeping your login details secret. A guest account is tied to your device; if you sign out or delete the app without linking it first, its data is lost.

3. Prohibited content and behavior

Objectionable content and abusive behavior are not tolerated. In particular, the following are prohibited: illegal content, glorification of violence, hate speech, pornography, harassment, content that endangers children, and images or texts you do not have the necessary rights to. This applies to decks, images, cards and player names.

4. Your content

You alone are responsible for ensuring that your content is lawful and that you have the necessary rights to it (e.g. copyright and personality rights in photos). Your content remains yours. You grant us a simple, free right to store, process and show it to everyone you share or play it with, to the extent necessary to operate the app. Anyone who knows the link or code of a deck can view it. If a deck is used in a game, its content remains part of that game even if you later change or delete the deck.

5. Indemnification

If third parties assert claims against us because of your content or behavior, you indemnify us against them to the extent you are responsible for the infringement. This includes reasonable costs of legal defense.

6. Reporting, removal, suspension

You can report decks and players in the app and block players. We usually review reports within 24 hours. We are not obliged to monitor content in advance. We may remove content that violates these terms or applicable law, or that is reasonably suspected to do so, without prior notice, and suspend or delete accounts.

7. Availability

There is no entitlement to use the app or particular features. We may change, restrict or discontinue the app at any time. We do not guarantee that the app is always available without errors or that stored content is preserved. Keep your own copies of important images and data.

8. Liability

As the app is free of charge, we are only liable for intent and gross negligence. This does not affect liability for injury to life, body or health, under the Product Liability Act, or for fraudulently concealed defects.

9. Ending use

You can delete your account at any time under “Delete account” in your profile.

10. Changes and law

We may change these terms with effect for the future. The current version is available in the app; if you continue to use the app after a change, the new version applies. German law applies; mandatory consumer protection rules of your country of residence remain unaffected. If any provision is invalid, the remaining provisions remain valid.
